| 摘 要： | 司法实践已充分说明,死刑的适用并没有遏止贪污贿赂持续上升的犯罪率,死刑的威慑力非常有限。鉴于此,本文认为,我国应该废止贪污贿赂犯罪死刑的适用,并从几个方面进行论证。最后,提出惩处和预防贪污贿赂犯罪在立法和司法上的建议。

| Abstract: | Judicial practice has proved that death penalty couldn t stop the rising of the crime of embezzlement and bribery and the deterrence of it is very limited.This paper illustrates that death penalty should be abolished and provides some suggestions concerning preventing and punishing the crime of embezzlement and bribery. |
