| 摘 要： | 管理型法官区别于裁判型法官，是英美国家民事诉讼中主要是审前程序中出现的法官新形象。由于普遍存在当事人滥用程序权，造成了诉讼迟延和诉讼成本高昂，英美国家进行了持久的民事司法改革，赋予了法官程序管理权，进行案件管理、程序管理和证据管理，以促进程序经济，保障实质正义的实现。借鉴管理型法官对改革和完善我国审前准备程序乃至整个诉讼程序都有非常重要的意义，能够纠正片面强调建立当事人主导审前程序的改革思路存在的偏差。

| Abstract: | In England and America,the party＇s abuse of litigious right caused unreasonable delay and high cost incivil procedure.So the reform of civil procedure has been conducted for a long time.As a result, the judge was granted to conduct case management,procedure managerment and evidence managerment.The new image of the judge was presented as managerial judge.It is necessary to introduce it to china in order to reform and perfect the pre-trial procedure in civil procedure. |
