| 摘 要： | 目的理性犯罪论体系是以新康德、新黑格尔哲学和政治哲学为其哲学基础的,是对新古典犯罪论体系与目的论犯罪论体系的继承与发展。在目的理性犯罪论体系的阶层构造中,客观归责与包含了需罚性的罪责是其核心创新,它们与该理论本身所蕴含的体系性思维模式一样,都对我国刑法犯罪论的研究具有重要的意义与价值。

| Abstract: | With Neo-Kantianism, Neo-Hegelianism and political philosophy as its philosophical foundation, Aim Rational Criminal Theory System is a theory carrying forward and developing the Neo-Classic Criminal Theory System and Aim Criminal Theory System. There are two core creative opinions, namely, Theory of Objective Imputation and Culpability including necessity of penalty, in the construction of aim rational criminal theory system. Furthermore, as the scientific systematical thinking way implied in this theory, they are of vital significance and value to Chinese criminal theory research. |
