| 摘 要： | 从我国目前法律、法规等规范性文件及实际运作出发,全面分析国民待遇原则在我国外资领域的实施现状及违背这一原则的不良后果和负面影响,并从立法指导原则、价值取向、法律重构、国家利益保护和制度整合等方面,对国民待遇原则在我国的贯彻执行提出了建议和对策。

| Abstract: | In accordance with the practical performance of China's laws and regulations, this paper analyzes the current situation of applying WTO's principle of national treatment in the field of foreign capital as well as the harmful results and negative impacts due to the violation of the principle. So far as the theory of legislation, orientation of value, reconstruction of law, protection of national interests, and synthesis of different systems are concerned, it also put forward some proposals and strategies to follow the principle of national treatment. |
