中国职业篮球的法制问题探析

中国职业篮球的发展离不开这一发展过程中的管理的维持、创新与制度保障。这一保障的实现主要取决于制度本身,取决于和这一制度框架指引下的管理者。然而,就中国的职业篮球而言,一种直线性、机械的法律制度移植和硬性实施,不利于中国职业篮球持续、快速、健康的发展。因此,本文提出符合中国职业篮球实体的,在建立人性化严格的、科学的法规制度的同时,融入人性化和柔性化的制度实施与管理的人性化法治。

The The development of Chinese professional basketball can' the t do without the maintenance and creativeness of the management,as well as the system security.The realization of this security mainly depends on the system itself and the managers under the guidance of it.However,as far as Chinese professional basketball is concerned,it is not helpful for its continuous,rapid and healthy development to transplant linearly and mechanically and to implement rigidly the law system.So this article is to put forward a suitable humanized legality for the reality of Chinese professional basketball,aiming at the construction of rigorous and scientific law,on the basis of which it is to implement and manage the system humanly and flexibly.
