试论法律渊源的定义

由于存在着部分法理学教材和部门法教材将法律渊源和法的形式两者定义混为一谈的现象,一些研究者认为不需要对法律渊源进行定义。学界存在着法律渊源与法的形式、法的形式渊源、法的形式意义上的渊源以及法的效力渊源几个概念的辨析问题。也有学者分别从法学方法论和司法角度理解法律渊源,丰富了研究法律渊源的思路,具有启发意义。法律渊源的研究不可停止,从字面意义入手,并以动静结合的方法理解法律渊源：先有法律渊源,后有法的形式和内容;法律渊源是法律的来源或者根源。法律渊源是指对法律的形成和运行有着决定性作用的,同时具备资源、进路和动因三者的因素。
