| 摘 要： | 对软件进行逆向工程是推动软件业创新发展的一个重要手段,但是许多软件著作权人通过软件许可合同限制逆向工程行为,因此引发了大量新颖的法律问题。针对我国计算机软件许可合同中大量出现的禁止逆向工程条款,在进行国际比较的基础上,应用知识产权法和合同法等基本法学理论对这一问题进行了具体分析,认为应当完善我国关于限制性条款和格式合同的具体规定来解决禁止逆向工程条款的合法性问题。
