With the vigorous development of Internet economy, data resources have become the core competitiveness of Internet platform enterprises. The data set with no personal information identification and economic value generated by Internet platform enterprises in the process of operation belongs to data property. At present, data property protection is facing many difficulties, such as legislative blank, academic doubt, embarrassment of judicial application, lack of industry autonomy and so on. Among various questions, there is still undeniable or alternative legitimacy of data property right, such as encouraging industrial innovation, conforming to fair value, promoting the efficient flow of data resources, etc. Therefore, based on the analysis of the advantages and disadvantages of the existing paths of legal protection of data property, taking Internet platform enterprises as an example, this paper attempts to build a new type of property right-data generator right, and explores its connotation, nature, power content, right restriction and right protection path, which can provide an academic reference for the legal protection of data.
