行政听证制度研究

我国行政听证制度起步较晚，到目前为止发展也不完善，对行政听证制度也没有进行系统的立法和制度规范。要促进我国的法治建设和实现法治国的理想，就必须要广大人民和全社会的广泛参与，而听证制度能够很好的解决行政机关在行政过程中所遇到的阻力，公开、公正、透明不仅是立法的生命，也是行政执法所必须遵循的准则。因此建立和完善我国的听证制度乃是法治的必然。

A study on the administrative hearing system

Administrative hearing system starts late in China, it is not perfected up to now. The administrative hearing system has no systematic legislation and regulations. In order to promote the construction of the rule of law in China and the realization of the ideal of legal state, people and society are required to participate in it, the hearing system can offer administrative departments solutions to the resistances in the process of administration. Open, fair and transparent legislations not only have strong vitality, but also are the rules in administrative law enforcement. Therefore, the establishment and perfection of the heating system is inevitable for the rule of law.
