| 摘 要： | 证据首先是一种客观事物;证据又是一种认识要求和认识标准,它与人的思维能力和思维目的保持一致;诉讼中的证据又是一个法律的范畴,体现在诉讼程序中的证据是一个能在不同层面上体现不同意义的综合体,具有自己独有的特征。

| Abstract: | This article will discuss the concept and character of evidence,so as to debute the present viewpoints on the evidence.The writer express three aspects about evidence :firstly,it is objective;secondly,it means an requirement and a standard of Human being knowledge;thirdly,procedural evidence is a part of law science.The writer will give some advice to the legislation of procedural law through this article have been given above. |
