| 摘 要： | 鉴于植物人群体的特殊性以及庞大性,自然而然引起民法的关注。因其身体的特殊性,理应属于无民事行为能力人。也正是因为我国关于植物人的法律人格制度立法空白,实践中的植物人医疗救助问题、婚姻问题、生育问题等都不同程度地陷入无法可依的窘迫境地。外国关于人身监护的立法,如增设预嘱制度、遗嘱指定监护制度、监护人监督制度以及完善监护人的监护内容等,对我国植物人人身监护的立法完善有借鉴意义。

| Abstract: | Because of the particularity of the vegetable,it naturally causes the attention in the field of civil law.Because of the particularity of the body,it is a person having no capacity for civil conduct.It also results from a vegetable of legal personality system in China,causing the legislation of the practice of blank brain-damaged guardianship system,the medical relief,brain-damaged marriage,fertility problems the varying degree in a lawless distress situation.There are personal care laws in foreign countries,such as add wills system,will specify guardianship system and guardian.They will help us to perfect our legislation. |
