论地理标志与商标权的冲突及其法律协调

摘    要:在市场经济环境下,地理标志是生产与竞争的纽带,引导着消费者购买的趋向,是一种蕴含着巨大价值的无形资产.目前,地理标志与商标权存在着冲突,但是在我国却没有一个完备的冲突解决机制.为协调地理标志冲突,发挥地理标志的价值,本文从地理标志与商标权冲突的现状、成因及其法律协调三个方面进行了初步的探讨.

Abstract:Under the market economy environment, the geography indication is a tie that production and competition to take, guiding the consumer to purchase, is a kind of immaterial assets containing the huge worth. Currently, there exists conflict between the geography indication and the trademark power. However, in the our country, there is no perfect mechanism to solve the problem. In order to moderate the conflict of geography indication, exert the value of geography indication, this article symbglizes from the present condition, the cause and the law moderate of the confliet between geographical indication and trademark power.
