| 摘 要： | 以美国宪法学说上的宪法积极义务理论为基础，分别介绍了康涅狄格州、马萨诸塞州、宾夕法尼亚州三个关于立法不作为的诉讼，在此基础上分析了美国州法院在立法不作为救济上所采用的方法和根据，以及判决的救济措施和法院在立法机关面前所表现出来的谦抑的一面．
