| 摘 要： | 司法实践中,由于司法人员对适用自首与立功的相关法律规定理解不一,加上法律规定本身的不完善,往往造成罚不当罪的情形.因此,依据立法精神正确理解相关的法律规定,对准确适用自首和立功制度十分必要.
