重大安全事故后的行政给付问题研究

安全事故发生后,政府为了避免激化社会矛盾、迅速平息事态、维护社会稳定,常常以行政给付的方式进行善后处理。政府主动、及时、优厚的埋单对于受害人来说无疑是莫大的安慰与补偿,但是政府行政给付法律性质不明,缺乏法定的实施程序,甚至可能掩盖政府在生产安全事故中监管失职的责任。种种问题促使我们深入思考如何对重大安全事故后政府的行政给付行为及其程序进行立法规范。

Once a major safety accident take place, in order to avoid intensified social contradictions andquickly calm things down, maintaining social stability, the government often takes the form of administrativepayment to cope with the aftermath of a disaster .The initiative, timely and generous government giving is undoubtedlya great comfort for the victims.But the legal nature of the government administration compensation isunknown, even lack of legal enforcement programs may cover up the responsibility of the government supervi -sory negligence in production safety accident.The above problems make us think deeply about how to legallyspecify rules and procedures of the government ’s administrative compensation after the major safety accident .
