| 摘 要： | 我国代位权制度对传统代位权制度“入库规则”的改造并不成功,“直接受偿”有损债权的相对性、平等性,无法融入民诉程序。代位权制度在现代社会日趋衰落,可借鉴国外经验,通过完善代位执行制度来取代代位权制度。

| Abstract: | This article presents an opinon that the reform the conventional obligee's subrogation isn't successful."Compensated directly"damages the relativity and the equality of creditor's right, and it can't merge into the civil action. The obligee's subrogation has been declining in modern times. Our country should draw lessons from the foreign experiences. The obligee's subrogation can be taken place by a perfect execution in subrogation. |
