| 摘 要： | 死刑替代措施的研究有助于推动中国死刑制度改革。国外死刑替代措施的立法例与构想有四种:以绝对的无期徒刑替代死刑;以相对的无期徒刑替代死刑;以有期徒刑替代死刑;以不定期刑替代死刑。在我国应当以特殊的无期徒刑替代死刑。以特殊的无期徒刑替代死刑时,我国刑法总则和分则的内容要作出相应的调整。
