| 摘 要： | 行政主体越权实施行政行为是经常发生、也是最典型的行政失范现象。分析行政越权的内涵及其表现形式，深入认识行政越权的法律后果，对于防止行政主体超越职权，避免行政侵权现象的产生，充分保障公民、法人和其他组织的合法权益，促进依法行政具有重大的现实意义。

| Abstract: | The administrative subject into practicing administrative behavior, which usually takes place and also is of the most typical administrative power out of control. This article have analyzed the abuse of administrative power and its manifestation, and deeply understood its legal consequence. It is of great realistic importance to promote rule of administrative law, prevent the administrative subject exceeding the authority, and avoid the administrative tort and safeguard the citizen, legal person and the other corporate. |
