| 摘 要： | 借用理性的目光审视我国的刑事诉讼活动———刑事不起诉及其论据与逻辑严密的论证,较完整地揭示不起诉的创制根据、发动根据、分配根据及其不起诉的执行根据,追寻不起诉正当性的极限,旨在建立一个完备的刑事不起诉正当性的理论体系。

| Abstract: | Hearing the deafening warning in new century that we are in a rational age, the author, who does not dare to slight the responsibility , has looked over the criminal nonprosecution in the present criminal procedure in our country. Based on the logically close reasoning of the existence, establishment, launch and distribution evidences, the author analyzes the execution evidence, with a view to look for the convincing grounds for argument and comprehensive justification, to establish a systematic nonprosecution theory. |
