| 摘 要： | 哈贝马斯提出"交往理性"代替工具理性,分析了法律的双重理论。布迪厄批判了语言的纯粹研究,认为语言是权力关系的一种工具或媒介,并不仅仅是沟通的手段。本文梳理了哈贝马斯的法律思想,并以布迪厄的理论对交往理性作了反思。

| Abstract: | Habermas proposed communicative rationality replacing instrumental rationality and analyzed the dual nature of Law.Burdieu criticized pure study on language,thinking that language is not only the means of communication,but also an instrument or medium of power.This paper makes an analysis of Habemas' legal thinking and makes an introspection on communicative rationality with Burdieu's theory. |
