| 摘 要： | 在学者们着力于对"和谐"概念的历史脉络进行梳理的基础上,"和谐"的历史意蕴在典籍中的解释几乎已经为人熟知。而将其置于当今中国的本土情境下,该概念的现代含义以及法学内涵却已经发生了极大的变化。这种变化可以通过古今中外的比较以及对现代法治社会背景的阐述加以呈现,此一解释过程能表明"和谐"概念的现实内涵。"和谐"概念意义变化的影响,存在着两种可能性,应当充分发挥其积极作用,抑制其消极影响,只有将和谐社会建设与法治衔接起来,这才是和谐社会的应有之义。

| Abstract: | After scholars hammer at tracing the concept of harmony in history,its meaning in classical books is familiar to many people.However,on the modern Chinese settings,its modern and juristic meaning has changed a lot.This change can be illuminated by the comparison in the eastern and western world and interpretation of modern legal society,which explain the meaning of harmony in nowadays.There are two possibilities of this changing,and we should make good use of it and restrain the negative impact. |
