| 摘 要： | 体育竞赛表演的法律保护一直是饱受争议的问题.本文从＂必要性＂和＂可行性＂角度下对此问题进行了分析;从洛克的劳动理论、人格财产论、经济激励理论及社会现实需要的角度论述了体育竞赛表演的必要性;尽管我国著作权法及实施条例也没有把体育竞赛表演纳入到表演法律保护中,但国外有的国家把部分体育项目纳入到表演的法律保护中,本文认为体育舞蹈、武术、花样游泳、花样滑冰、艺术体操、健美操等体育项目受著作权法保护完全具有可行性.

| Abstract: | The legal protection of sports competition show has been a highly controversial issue.This article analyses this issue from＂necessity＂ and ＂feasibility＂perspective;From Locke＇s labor theory,personality theory of property,economic incentive theory and practical needs of the community perspective on the sports competition,the paper discusses the necessity and feasibility;Inspite of China＇s Copyright Law and the implementing regulations have not let sports performances into the legal protection.Some countries abroad included some sports into the legal protection of performers.The sport dance,martial arts,synchronized swimming,figure skating,artistic gymnastics,aerobics and other sports,should be subject to copyright laws. |
