试论我国城镇医疗制度的改革与医疗保障法的建立

随着客观形势的变化,现行的医疗保险制度已不能适应新形势的需要,尤其不能适应社会主义市场经济体制的需要,进行医疗制度改革势在必行.为了保障医疗改革的顺利进行,有必要制订一部长期适用的医疗保障法.文章拟就通过分析我国原有医疗制度的弊端和阐述医疗制度改革的基本思路,来探讨将要出台的医疗保障法的有关法律问题,包括该法的立法原则、主体、客体、权利义务关系及法律责任等.同时,文章还探讨了医疗保障法在整个市场经济法律体系中的地位与作用.

A Tentative Analysis of the Reform of Medical Service System and the Establishment of the Law of Medical Guaranty

As the objective situation changes,the existing medical insurance system can't meet the needs of the new situation,especially the needs of the socialist market economy.Thus the reform of medical service system is inevitable.For the smooth going-on of the medical service reform,a law of medical guaranty suitable for long-term use is necessary.This article explains the disadvantages of the existing medical service system,expounds the guidelines of reforming the medical service systems and explores some legal issues such as legislative principles,subjects,objects,relationship between responsibilities and rights and legal duty in the forthcoming law of medical guaranty.In the meantime,this article also explores the position and function of the law of medical guaranty in the legal system of the market economy.
