| 摘 要： | 通过分析现行《行政许可法》中的行政许可延续申请的默示批准制度，指出默示批准制度存在许多不合理的地方，主要是与设立和实施行政许可的目的不一致；不一定有利于保护行政相对人的利益及公共利益；不利于对违法人员的责任追究等。从而得出结论：行政许可延续申请应以默示驳回为原则。

| Abstract: | This paper,by analyzing the tacit approval system that continues application for administrative licensing in the "Laws on Administrative Licensing",points out that the system is unreasonable in many aspects,and is inconsistent with the purpose for which the system has been established and implemented.This may not facilitate in protecting the interest of the administrative relative man or penalize the offender.A conclusion is reached that the application for the renewal of administrative licensing should be rejected tacitly. |
