| 摘 要： | 司法实践中,刑事和解的方式主要是经济赔偿,这容易给公众造成刑事和解系花钱买刑的印象,并会造成一系列的负面影响。为完善我国刑事和解制度的适用,必须改进现有的单一化刑事和解方式。在适用刑事和解方式时,应当遵循自愿、公平、务实等原则;在保留现有的刑事和解方式的基础上,应构建多元化的刑事和解方式;在多元化的刑事和解方式中,经济赔偿仍应被视为主导方式,赔礼道歉应成为必要方式;为配合多元化刑事和解方式的构建,有必要采取相应的配套措施。
