如此仲裁将失信于民

仲裁在息纷止争、促进社会主义市场经济和建设社会主义和谐社会中发挥了积极的作用,但是一些仲裁员在处理仲裁案件上存在的问题却不容忽视。广东省肇庆市仲裁委员会2006]肇仲字37号裁决是一起法律关系简单的民事仲裁案,但却出现了案件的主要事实不清、裁决“违约”无证据、同样事实两种不同裁决结果、增加仲裁请求未补交仲裁费等问题。提出这样的仲裁将失信于民,应当引起法律界的高度重视。

Arbitration has played an active part in settling disputes and helping to form a harmonious society with socialist market economy. However, problems arising from arbitration made by some arbitrators should not be ignored. A case in point is No. 37 Arbitration Award by Zhaoqing City Arbitration Committee in 2006, which concerns a simple case of civil arbitration, yet problems such as ambiguous evidence, contradictory results of arbitration, and appeal from clients for repeat arbitration arose from it. Such arbitration will lose the confidence of people, so it should be paid more attention by the circle of the law.
