| 摘 要： | 合同中的权利瑕疵担保与物的瑕疵担保一样,是合同当事人必须履行的一项基本的法定义务。权利瑕疵担保在担保的时间、效力、内容、法律后果上与物的瑕疵担保存在着重大的差别。权利瑕疵担保的目的在于保证债权人对依合同享有的债权能真正得到实现。

| Abstract: | The right in the contract minor faults guarantee is similar to the minor faults guarantee ofthe thing is a basic legal duty that the party of contract must.implement. The right in the contract minorfaults guarantee is distinct from the minor farlts guarantee of the thing in guarantee time, guaranteecontent and legal consequence. The right minor faults guarantees with an eye to guarantee the creditor tocan be real to be realized according to the contract to the legal right that possess. |
