| 摘 要： | 中国是一个航运大国,也是世界海事组织的理事国,且有着较大的油类进出口量,然而它却不是《1992国际油污赔偿基金公约》的成员国,而且也尚未建立国内油污基金.针对以上情况,论述国内油污赔偿基金建立的必要性,比较国际上现有的三种油污基金模式,分析油污基金的法律特征,提出建立国内油污基金的建议.

| Abstract: | China,as a big shipping country and a council of In- ternational Maritime Organization(IMO),has great amount of oil imports and exports.However it is not a member state of the International Oil Pollution Compensation Fund 1992(FUND 92)and does not establish a national compensation fund for oil damage.This paper compares the current three different com- pensation fund models and analyzes the legal characters of the oil pollution compensation fund,then gives some suggestions on es- tablishment of national oil pollution fund in China. |
