| 摘 要： | 听证程序已逐渐融入我国公共权力运行机制,开始成为公众参与和评价的一种主要形式。最新修改施行的《烟草专卖行政处罚程序规定》对听证程序做了修改完善,具有一定的进步意义。但其在听证程序的适用范围,案卷排他性制度,听证主持人制度等方面并未有实质性突破,存在诸多缺憾,有待进一步改进。
