从日本外大陆架划界案看冲之鸟礁之法律属性

联合国大陆架界限委员会(CLCS)对日本外大陆架划界案给出建议摘要,决定推迟对以冲之鸟礁为基点的九州帕劳海岭南部区块的审议。这一建议说明委员会并不认同日本以冲之鸟礁为基点主张外大陆架。从法律属性上看,冲之鸟礁是《联合国海洋法公约》第121条规定的不能维持人类居住和经济生活的岩礁,不能拥有专属经济区和大陆架。日本外务省声称日方以冲之鸟礁为基点主张的区块获得批准的言论是不符合《大陆架界限委员会第29届会议主席声明》和大陆架界限委员会《日本划界案建议摘要》原义的误导。

Analysis of the legal attribute of Okinotorishima from the aspect of delimiting the outer Limits of Japan Continental Shelf beyond 200 nautical miles

Commission on the Limits of the Continental Shelf （CLCS） made a proposal for delimitation the outer limits of Japan continental shelf beyond 200 nautical miles, and decided to defer consideration for Southern Kyushu Palau Ridge Region that they determined Okinotorishim as a base point for Japan~ continental shelf. CLCS not to acknowledge Japans claims over outer conti- nental shelf based on Okinotorishim. According to Article 121 of the UN Convention on the Law of the Sea, from the legal attrib- ute, Okinotorishim is a group of rocks which cannot sustain human habitation or economic life of their own and shall have no ex- clusive economic zone or continental shelf. Such claims that ＂Okinotorishim＂ can only be as the base point is not in conformity with the provisions of the delimitation of outer continental shelf. It is also mislead for Japan~ Foreign Ministry officials that Okino- torishim ＂island＂ is base point for Kyushu - Palau Ridge Region from Summary of recommendations of the commission on the lim- its of the continental shelf in regard to the submission made by Japan on November 2008 （CLCS） and Progress of work in the Commission on the Limits of the continental Shelf - Statement by the Chairperson.
