超越公正与功利——死刑的人道视角

死刑存废的问题是世界观、价值论问题，死刑的价值基点有三方面：公正、功利、人道。剥夺犯罪人生命的死刑是违反人道精神的，是非人道的，退出历史舞台是它的必然宿命。公正的内涵、表现形式在不断变化，并非一成不变的。在文明社会，人道主义精神赋予了公正更丰富的内涵，残酷的、毁灭性的死刑因其消极的社会价值被理性的公正所抛弃，人道超越了公正。死刑虽具有效益性，但不具有公正性和人道性，废除不具有人道的死刑是一种合理的选择，人道超越功利而约束功利。由于对社会本位价值的选择和受经济条件与人文基础的制约，中国目前不能废除死刑，只能限制死刑。但作为理念的死刑废除是中国应然而必然的选择。
