| 摘 要： | 侦辩交易是不同于诉辨交易的一种形态，在国内外侦查实践中均存在，如我国的坦白从宽，美国的刑事免责以及污点证人制度。侦辩交易的主体虽然是侦查机关和犯罪嫌疑人及其辩护人，但侦查机关主要是通过向公诉机关和审判机关提出建议来践行交易。
