完善我国涉外产品责任法律适用问题的思考及建议

随着全球经济交往的加快和科学技术的高速发展,涉外产品责任案件日益增多。但对于产品责任的立法各国存在冲突,而且我国至今还没有调整涉外产品责任法律适用的专门制度,只是笼统地采用了侵权行为法律适用规则,使特殊复杂的涉外产品责任案件的法律适用简单化、机械化,忽视和掩盖了其他与产品责任案件具有更密切更重要的连接因素,无法切实地保护受害人的合法权益。据此,本文拟在评述传统冲突规则缺陷的基础上,剖析涉外产品责任法律适用的发展态势,结合本国的实际情况对我国在该领域的相关立法提出合理化建议,以期对我国的立法有所裨益。

Thinking and Suggestions on Perfecting the Legal Application of Import and Export Products

Along with the global economic exchanges and the rapid development of science and technology, there are increasing cases concerning foreign-related product liability. But the geeat conflict exiss about legislation ot product liability in conflict, and we have not yet adjusted the legal application of responsibility of foreign prod- ucts .Just make the complex cases simplified and mechanized, ignoring some important factors daely comnected with cases other products liability has more not being able to protect the legal rights of the victims. Accordingly, this paper has reviewed the traditional conflict rules,the legal application of responsibility of foreign products analyzed the and combined with actual situation in China in the relevant field and put foruard the rational suggestions to benefit the legislation in China.
