| 摘 要： | 行政权力具有双重性,既管理了公共事务,维护了公共秩序,保障了行政相对人的合法权益;同时由于各种原因,行政权力的行使与行政法的原则、规定、程序相偏离,导致危害甚至破坏公共秩序,也损害了行政相对人的合法权益,对于处于“弱者”地位的行政相对人应给予更多制度上的权益保障。

| Abstract: | Administrative power has double meanings. One is to administrative public affairs and protect public system, in order to indemnify legal rights and interests of people. The other is to damage legal rights and interests of people because of various causes. Administration performs authority and duty illegally so that its outcome deviates Administrative Law .For the people is "the weak", we must consummate administration system step by step, so as to ensure that the subject's rights and interests can be better indemnified. |
