通过对日本《文化财保护法》中有关无形文化遗产、传承人和传承团体、民俗文化遗产等概念的辨析,以及日本在非物质文化遗产的保护与活用方面所采取的具体措施和案例等的分析,认为日本是少数几个在非物质文化遗产保护和利用方面走在世界前列的国家之一,其最成功的经验就是通过立法的方式使得非物质文化遗产保护和利用具有可持续性。

Legal Protection of Intangible Cultural Heritage in Japan

By analyzing the concepts of intangible cultural heritage, inheritors or inheriting organizations, and folk cultural heritage in the Japanese Law for the Protection of Cultural Properties, and the specific cases of protecting intangible cultural heritage, this paper argues that Japan is one of the few countries that have done a good job in protecting and utilizing cultural legacies. Its success lies in that the protection and utilization of intangible cultural heritage have been made sustainable through legislation.
