试论排污权交易制度在我国的立法建议

排污权交易是一种以市场为基础控制环境污染的经济手段,是当前备受各国关注的一种环境政策。但在我国,排污权交易制度尚缺乏相应的法律支持。存在着污染物排放的总量控制问题、排污权的初始分配问题、排污权交易的市场机制等不同问题。从法律层面上,应明确交易主体,明确交易的法定程序,发展排污权交易市场和中介机构,确定交易罚则。

Suggestions on the Law-making in Transaction System of Pollution Discharge Rights

As an environment policy of common concern in many countries,transaction of pollution discharge rights,which is based on market,is an economic means aimed to control environmental pollution.However,the transaction system of pollution does not receive due legal support in the control of volume of pollutants discharged.The allocation rights in pollutants discharge and market mechanism in transaction of pollution discharge rights is not clear.The paper holds that on the law level,the transaction subjects and procedures should be clarified,transac-tion markets and media organizations should be established,and the rules of punishment should be made.
