| 摘 要： | 先占是动产所有权原取得的方式之一，这一现象在我国现实生活中是存在的，但是法律中并未加以规定。这是我国法律的不完善，对此，本文试从先占的性质、先占的立法例、先占的条件及我国的先占制度加以阐析。

| Abstract: | Preoccupation is one of the primitive methods to gain the possession of movable property. This phenomenon does exist in the real life in our country, but it has not been regulated by law, Which reveals incompleteness of the legal system in our country. This paper attempts to expound the preoccupation's nature,legislative samples, preconditons and the system in our country. |
