| 摘 要： | 行政指导是市场经济所要求的行政民主化的结果。由于我国行政指导制度缺乏法律明确规定,导致行政指导在实践中存在责任归属不明确等诸多问题。从行政指导的理论背景及价值定位入手,对我国行政指导的责任追究体制进行了探讨,认为现阶段构建行政指导责任追究体制应当遵循合理性原则,完善有关立法和配套措施,来实现行政指导的法治化。

| Abstract: | Administrative guide is the requirement of democracy of maket ecnomy.The unclear regulation in our administrative guide system leads to the indefinite responsibility.This artide disusses the responsibility system of the(administratie) guide from the theoretic background and the value orientation.Principles should be followed to erect our system of administrative guide responsibility to perfect legal and supporting measures and realize ruling by law. |
