| 摘 要： | 在欧盟的法律秩序当中,欧盟法院担任着一个关键的角色,通过其判决持续地为欧盟的法律秩序强化司法的保护。在公共服务业的各种限制竞争行为中,滥用优势地位是其主要的表现形式。20世纪90年代欧盟竞争法的显著发展之一就是出现了"基础设施原则"(EFD)这一重要法律规定,而这一时期欧共体法院的司法判例有着深远的影响。

| Abstract: | The European Court plays a very crucial role in the EU legal order, and it continued to enhance judicial protection by its judgments. In the various restrictions on competition of public utilities, abuse of dominant position is the main manifestations. One of the notable development of EU competition law in 1990s is the emergence of "essential facilities doctrine" (EFD),which is important legal provisions. In this period, the EC Court of Justice cases have far-reaching effects on it. |
