从哲学角度重新审视法律,属于历史反思的范畴。中西方哲学思维的不同进路导致了直觉与建构之间的冲突。对存在、时间、虚无的进一步认识有助于厘清思维的混乱,同时给予思维以发展的方向。唯有在形而上的正确引导下,对于法律这一实在法才能有充分的了解。既把握自然的脉动又蕴涵人类自身的生存目的,在人与物的对立之间着重关注其中的法律关系、互动和流变。以事物的存在、时间和虚无为先导的三元论,将重塑法律概念、法律关系和法律规则,并以权利的构造为例解析实在法。

Being, Time and Absence——A Philosophical Methodology to Analyze Law

To review law from a philosophical aspect is a matter of historical reflection.The differences between Chinese and Western philosophical thinking patterns result in the conflicts between intuition and construction.A further step in understanding being,time and absence helps put straight confusion in the train of thought and direct the development of thought.Only under the right guidance of metaphysics can we gain an insight into the positive law.By getting hold of the pulse of nature and implying persons' purpose of subsistence,this paper focuses upon the legal relation,interaction and gradual change in the opposition of person and matter.The Triunity with being,time and absence as its guides,is to redefine legal concept,legal relation and legal rule,furthermore,to analyze positive law by presenting the example of construction of right.
