| 摘 要： | 基因资源是生物多样性的重要组成部分。人类已经进入基因技术时代,基因所蕴含的财产价值日渐显现。在给予基因知识产权保护中,最重要的是解决基因专利的利益分享问题。通过对基因资源的惠益分享的立法基础、分享主体和分享范围进行分析,并对基因资源惠益分享的模式进行探讨。

| Abstract: | Genetic resource is an important component of biodiversity.Mankind has entered the era of gene-technology and the value of the genetic has increasingly apparent.In the intellectual property protection of the gene,solving the problem of sharing benefits about gene patents is the most important.Talking about the legal basis of the benefit-sharing of genetic resource,the main body,scope and sharing mode,the sharing mode of the genetic resource should be established. |
