检察权视野下的刑罚个别化方法

“应受惩罚的是行为，而惩罚的是行为者”的观点，是对刑罚个别化的高度的概括，实现了以“行为为中心”到以“行为人为中心”刑罚理论的转换，体现了“防卫社会”的刑罚目的观，“人身危险性”成为实施刑罚的真正基础。在我国具体的司法语境下，刑罚个别化的司法实践活动离不开检察权重要作用的实现。检察权与刑罚个别化具有天然的亲和力，也是实践刑罚个别化最便利、最适宜的方法；以“人身危险性”为重要参数，运用不同的司法方法和具体方法，检察权主导下的刑罚个别化司法实践活动，能够促进量刑建议、刑事和解、辩诉交易、非监禁化、刑罚解除等司法改革的发展；检察权通过介入对犯罪人的人格调查、数据分析、案件说理，为刑罚提供合理的依据，促使犯罪人回归社会，实现社会正义和秩序。

The Methods on Individualization of Penalty in the View of Procuratorial Power

The point of view that the behavior should be punished but the law punished the doer is the higher generalization on individualization of penalty. The view realized the conversion of the center of behavior into center of doer and showed the aim of defense of society. The personal fatalness is the real foundation of the penalty. In our country, to realize the individualization of penalty the procuratorial power need bring into play more important function. In the view of procuratorial power, many judicial methods and idiographic methods should be used.
