| 摘 要： | 环境侵权的精神损害是区别于人身损害和财产损害的一种精神利益的伤害,对精神损害进行赔偿目前已成为环境侵权民事责任的重要组成部分。我国环境侵权精神损害赔偿制度无论在立法还是在司法实践方面都存在不足,有必要借鉴国外的先进经验加以完善,以期能更好地维护受害者的合法权益。
