| 摘 要： | ＂春秋决狱＂是汉代一种特殊的断案形式,从汉武帝开始,以后盛行于两汉。其出现的根本原因是汉武帝时期经学意识形态的确立。此外,政治利益的驱动和古代法律对官贵的不适用性也是其出现的重要原因。

| Abstract: | ＂Trial by following Spring and Autumn＂,originating from Hanwu Emperor and prevalent in the Han Dynasty,is a special form of settling a lawsuit.The major reason for its appearance is the establishment of Confucian ideology in the period of Hanwu Emperor.In addition,the drive of the political interests and inapplicability of the ancient law toward officers are also important reasons. |
