滥用职权罪共犯责任的认定

国家机关工作人员经集体讨论后决定实施的滥用职权行为，参加并持赞同意见的人员，成立该罪的共犯。国家机关工作人员上下勾结、内外勾结实施滥用职权行为的，成立该罪的共犯。国家机关工作人员与非国家机关工作人员共同实施滥用职权行为，同时符合两种以上犯罪构成的，按想象竞合犯处理；仅构成滥用职权一罪时，依该罪的共犯处理。

Defining Accomplice Liability of Abusing Authority

The state functionaries who decide to abuse authority after collective discussion, and support the decision are the accomplice of this crime. The state functionaries who collude between the upper and the lower and collude both from within and without to abuse authority are the accomplice of this crime. The acts performed by the state functionaries to abuse authority together with non-state functionaries, which measure the formation of more than two kinds of crime are dealt with as imaginary concurrent criminals. If it only constitutes the abuse of authority, it should be dealt with as the accomplice of this crime.
