论法的社会权利分析理论

从权利义务法理学近十年的推广和应用情况看 ,存在着功能性和结构性两大缺陷 ,已适应不了建设社会主义法治国家的要求。由于社会权利分析理论更新了法理学的学科方法论 ,拓展了法理学研究的纵深 ,提高了研究的科学性 ,更适应我国社会主义初级阶段的实际情况和建设有中国特色社会主义理论的要求 ,因此 ,社会权利分析理论应当成为新的法理学选择的学科方法论

On the analytical theory of social right of law

There are still two shortcomings in the functions and structure in the spread and duty application of right and duty jurisprudence over last ten years. It does not suit the demand of the ruling by law of constructing socialist country. The analytical theory of social right suits the realistic situation of the socialist elementary period of our country and the theoretical demand for constructing socialism with Chinese special characteristics as it has renewed the scientific method of jurisprudence, opened up the depth of jurisprudence research,and improved the scientific level of the reseach. So the analytical theory of social right should be the scientific methodology selected by new jurisprudence.
