| 摘 要： | 商鞅依法治吏的思想建立在"好利恶害"的人性论基础上,它具体包括:将官吏的管理体制用法律的形式加以确认,将官吏纳入法律监督的轨道,并以重刑的心理威慑效力预防官吏犯罪等几个方面.商鞅依法治吏的核心在于运用法律规范官吏的行为,以达到澄清吏治的目的.其治吏思想具有一定的现代启示意义.

| Abstract: | Based on the ideas that man by way of nature is preferring good to bad,Shangyang suggested that bureaucracies be governed with laws and regulations.The thought includes:by laws establishing a bureaucratic system and a sureillance system;preventing bureaucracy crimes with the psychological power of punishment,etc. The root of Shang's thought,making bureaucracies' actions conform to the standard with the force of regulations to clarify the hierarchy, gives inspiration to the governing of modern officials. |
