| 摘 要： | 本文运用系统论、控制论和信息论,把人类活动归结为控制自然和控制自身两个方向,指出了两种活动在主体、客体及其使用的控制手段方面的差别,并认为在现代社会,人类控制自身的活动主要由法律系统来完成的,进而提出通过法律进行社会控制的模型。作者从法治系统各子系统之间的关系及其社会环境的关系等方面研究了通过法律进行社会控制的机制,阐述了法律是如何通过对个人的控制达到对社会的控制的,这是从一个全新的角度来讨论了法的本质及其作用。

| Abstract: | By using such modern science methods as system theory, cybernetics andinformation theory, the paper sum up the human activities to two directions:control nature and control human hisself, and show the diference between thethe kinds of activities in subject, object and their controlled means. It descri-bes the controlling mechanism and its model of social system using law means,and discusses relation between law subsystems and relation between law systemand enviroment, Therefore, expoundes how law controlling whole society thro-ugh controlling in dividual. The author studies the essence and function of lawfrom a new model of thinking. |
