信访制度的困境与解决途径探析

信访制度承担了利益表达、民主监督、权利救济的功能,发挥了一定的作用.但本质上,作为一种行政救济手段的信访制度,人治色彩浓厚,客观上消解了国家司法机关的权威,其制度的内在困境也日渐凸显.要解决信访问题,就必须加强法治并重构信访组织机构和制度功能.

The Predicament of Letters and Visits and the Resolution

The system of letters and visits has the function of benefit expression,democratic supervision,and right relief.However,the system,being essentially an administrative relief means,carries strong color of being human controlled and objectively resolves the state judicial authority.The predicament of the system is becoming apparent.The paper suggests that legal system should be strengthened and organization of letters and visits and system function be reconsidered so as to solve the problem of letters and visits.
