| 摘 要： | 现阶段不少高校在基建项目建设过程中采用BOT方式,但我国有关高校BOT建设的立法仍属空白。高校必须在建设项目的选择、合作对象的确定、建筑工程的发包、施工过程中遵循法定程序和要求,才能确保高校基建项目BOT建设合法进行。

| Abstract: | BOT is adopted by many colleges and universities in the process of infrastructure projects at this stage. However, there is still a vacancy in the legislation of how to conduct BOT by the colleges and universities. To ensure the BOT of infrastructure projects to be conducted legally, the colleges and uni- versities must follow the statutory procedures and requirements in the choice of infrastructure project, partners and the bidding, constructing of infrastructure projects. |
